GENERAL DEFINITIONS

These definitions may vary slightly according to local data privacy laws.

“Personal Information” is any information relating to an identified or identifiable natural person (which in some jurisdictions may include individuals who are recently deceased, and whether or not the information is true) or to a legal entity (to the extent protected under applicable data protection law), recorded in any medium including but not limited to electronic, paper, or voice recordings. It may include information such as name, address, date of birth, identification numbers, financial information and any other identifiable personal information. Personal Information may include non-identifiable information which, when combined with other information to which MCA Suite is likely to have access, can be used to identify an individual.

Our “Services” includes our Site and any other any services, features, content, or applications offered by MCA Suite.

Examples of “Personal Information” relevant to MCA Suite may include:

  • User Information: User’s name, email address, business address, company-related information and Site registration details such as username/password details.
  • Usage Information: Information collected from our Sites, including pages visited and documents viewed and information about the browser, device or application you used to access the Site. Some of this information is collected using cookies and related technologies. To learn more, please see below.

“Processing” means any operation that is performed on Personal Information, whether or not by automatic means, such as collection, recording, organization, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, blocking, disabling or destruction.

“Sensitive Personal Information” is a subset of Personal Information, which due to its sensitive nature has been classified by law or policy as requiring additional privacy protection. Sensitive Personal Information may include, without limitation, race, ethnicity, health information, biometric information, religion, gender, sexual orientation, medical/health records, credit card information, dietary requirements, political beliefs and criminal history.

“Third Party” or “Third Party Service Provider” is any natural or legal person, public authority, agency, or other body apart from MCA Suite that processes or stores Personal Information solely on behalf of and under the instructions of MCA Suite.

“Client” means a customer of MCA Suite.

“Client Data” means personal data, reports, addresses, and other files, folders or documents in electronic form that a User of the Service stores within the Service.

“Personal Data” means any information relating to an identified or identifiable natural person.

“Public Area” means the area of the Site that can be accessed both by Users and Visitors, without needing to log in.

“Restricted Area” means the area of the Site that can be accessed only by Users, and where access requires logging in.

“User” means an employee, agent, or representative of a Client, who primarily uses the restricted areas of the Site for the purpose of accessing the Service in such capacity.

“Visitor” means an individual other than a User, who uses the public area, but has no access to the restricted areas of the Site or Service.

COLLECTION OF INFORMATION

You retain ownership of information you personally author and collected through the Site; provided, however, that you grant MCA Suite (and our successors and assigns) a worldwide, irrevocable, perpetual, fully-paid license to use any User content in any manner reasonably necessary for us to operate and provide the Services. MCA Suite will not sell, share, or rent this information to others in ways different from those disclosed in this Privacy Policy. MCA Suite may collect information at several different points on the Site. We collect information in two ways:

Information Provided Directly by You

Information voluntarily provided by you to MCA Suite. When you register, use the Services, subscribe to our alerts, or contact us directly, we may collect the following types of information:

  • Contact information, including your name, email address, mobile phone number, and address.
  • Login information, including username and password.
  • Payment information, including your credit card information.
  • Personal information when you send us a message through the “Contact Us” page or similar features on our Site.
  • Any other information you provide to us.

Information Collected Automatically

Information accumulated through use of the Services. MCA Suite may collect information about the Services that you use and how you use them. This information includes, but is not limited to:

  • Device information: We may collect device and device-specific information (such as your laptop or mobile device, hardware model, operating system version, unique device identifiers, and mobile network information including your phone number). MCA Suite may associate your device identifiers or phone number with your MCA Suite account.
  • Log information: When you use the Services or view content provided by MCA Suite, we may automatically collect and store certain information in server logs. This may include: details of how you used our service, duration of use, SMS routing information, internet protocol addresses, device event information such as crashes, system activity, hardware settings, browser type, browser language, the date and time of your request and referral URL and cookies that may uniquely identify your browser or your MCA Suite account.
  • Unique application numbers: Certain aspects of the Services include a unique application number. This number and information about your installation (for example, the operating system type and application version number) may be sent to MCA Suite when you install or uninstall that service or when that service periodically contacts our servers, such as for automatic updates.
  • Local storage: We may collect and store information (including personal information) locally on your device using mechanisms such as browser web storage (including HTML 5) and application data caches.
  • Cookies and anonymous identifiers: We use various technologies to collect and store information when you use the MCA Suite application and/or related website, and this may include sending one or more cookies or anonymous identifiers to your device.

USE OF INFORMATION

MCA Suite uses the information collected as set forth above to provide, maintain, protect and improve the Services, to develop new ones, and to protect MCA Suite and our users. MCA Suite does not sell or rent your information to telemarketers and we do not share information that can be used to personally identify you, except as follows:

  • MCA Suite reserves the right to share your information with the MCA Suite group of companies, trusted business partners, such as system integrators, distributors, and referral partners and any other business partners specifically identified by MCA Suite on the website where you submit your personal information.
  • MCA Suite may provide your information to agents and third-party service providers who process data only on our behalf and for our purposes under separate agreements. For example, we work with third party service providers who provide website, application development, hosting, maintenance, security and fraud detection, and other services for us. These third parties may have access to, or process Personal Data or Client Data as part of providing those services for us. We limit the information provided to these service providers to that which is reasonably necessary for them to perform their functions, and our contracts with them require them to maintain the confidentiality of such information. However, we are not responsible for any breaches by third-parties in maintaining the privacy of any shared information.
  • MCA Suite may share information provided by you as required by law or in the interest of protecting or exercising our or other’s legal rights, for example in connection with requests from law enforcement or court proceedings.

MCA Suite collects passively tracked data primarily for purposes of administering, protecting and improving the Site and our systems, to better understand the preferences of Users and Visitors, to identify server problems, to compile aggregated statistics about site usage, and to help personalize your experience on the Site.

MCA Suite collects actively submitted data primarily for two purposes: firstly, for the purpose for which you originally sent us the data; and secondly, for purposes of contacting you to further discuss your interest in our company, the services we provide and ways we can improve them to provide information on services, promotions and events. You can opt out of receiving marketing emails as explained below.

MCA Suite will ask for your consent before using information for a purpose other than those that are set out in this Privacy Policy.

MCA Suite processes personal information on our servers in many countries around the world. We may process your personal information on a server located outside the country where you live.

DISCLOSURE POLICY

MCA Suite may share your personal information with selected entities that act on our behalf as our agents, suppliers, or providers, or these entities may collect your personal information on our behalf. This is to enable us to more efficiently provide the Services. These service providers may provide services such as technical assistance, data hosting, payment processing and customer service support.

Legal Compliance and the Protection of Rights: We will share information with regulators, government authorities, and third parties where we believe it is necessary to comply with a court order, subpoena, or regulatory request. We may disclose information when we believe in good faith that such disclosures will help protect our rights or enforce our Terms of Use; support our detection of, prevention of, or response to fraud or intellectual property infringement; to help protect safety or security, or protect the safety or security of the Services, or any individual.

CUSTOMER CHOICES

Whenever you use the Services, we aim to provide you with access to your personal information. If that information is wrong, we strive to give you ways to update it quickly or to delete it – unless we have to keep that information for legitimate business or legal purposes. When updating your personal information, we may ask you to verify your identity before we can act on your request.

We may reject requests that are unreasonably repetitive, require disproportionate technical effort (for example, developing a new system or fundamentally changing an existing practice), risk the privacy of others, or would be extremely impractical (for instance, requests concerning information residing on backup tapes).

Where we can provide information access and correction, we will do so for free, except where it would require a disproportionate effort. We aim to maintain the Services in a manner that protects information from accidental or malicious destruction. Because of this, after you delete information from the Site, we may not immediately delete residual copies from our active servers and may not remove information from our backup systems.

We honor the users’ rights under applicable law to access, correct, update, erase, disable and block their Personal Information when lawfully requested to do so. In some circumstances, a data subject may have the right to obtain a copy of his or her Personal Information or object to processing of his or her Personal Information; to withdraw consent to the collection, use or disclosure of his or her Personal Information for any purpose; and/or to obtain information about how his or her Personal Information has been used or disclosed.

We will provide Clients with access to their Personal Information and honor other rights, including the withdrawal of consent, as applicable upon request sent to privacy@mcasuite.com.

INFORMATION SECURITY

We work hard to protect MCA Suite and our users from unauthorized access to or unauthorized alteration, disclosure or destruction of information we hold. In particular:

  • We encrypt many aspects of the Services using HTTPS protocol, including Sensitive Personal Information.
  • We review our information collection, storage and processing practices, including physical security measures, to guard against unauthorized access to systems.
  • We restrict access to Personal Information to MCA Suite employees, contractors and agents who need to know that information in order to process it for us, and who are subject to strict contractual confidentiality obligations and may be disciplined or terminated if they fail to meet these obligations.

DATA INTEGRITY

We endeavor to keep Personal Information accurate and current; and we update it whenever we receive a request to do so, as described below under:

  • We take reasonable steps to ensure the Personal Information we have collected is accurate, complete, and current.
  • We rely on the accuracy and completeness of the Personal Information that has been provided to us to perform the Services requested.
  • We will ensure that any changes that we are required to make to Personal Information be updated in a timely fashion.

DATA SECURITY

We take reasonable measures to protect information including from loss, unauthorized access, theft, misuse, or unauthorized disclosures, including, but not limited to, encrypting data at the records level and storing the encryption key in KMS (Key Management Services). Notwithstanding the foregoing, no data storage system or transmission of data over the internet or any other public network can be 100% guaranteed to be secure. We are not responsible for the security of information collected by third parties.

DATA RETENTION

We will retain your information for as long as your account is active and thereafter as long as reasonably useful for internal purposes to improve the Services and also to provide you with information in the future regarding our and our partners’ products and services. We may be required to retain your information to comply with our legal obligations, resolve disputes, and ensure the enforcement of agreements.

USER OBLIGATIONS

Client online access of Personal Information may be protected with a password you select. We will never ask you for your password in any unsolicited communication (such as letters, phone calls, emails messages, text messages, etc.), The Client has an obligation to keep their user ID, password, and personal information secure. As part of maintaining this obligation we recommendation that you do the following:

  • Keep your user ID and password confidential.
  • Utilize a unique password and change it as necessary.
  • Make sure others are not watching you enter your use ID and/or password on your device.
  • Do not leave any information system unattended while logged in and after you have finished accessing your information, log off and exit the service.

STORAGE OF INFORMATION

Personal Information we maintain may be stored in or outside of the United States. If you live outside of the United States, you understand and agree that we may transfer your Personal Information to the United States. The Site is intended for use in the United States and is subject to the laws of the United States, which may not provide the same level of protections as those in your own country.

LINKS TO THIRD PARTY SERVICES

Our Site may contain links to other third-party sites, plug-ins, applications or other online services. If you click on a link to a third-party site or other online service, you will be taken to a site or other online service we do not control and that is not governed by this Privacy Policy. We are not responsible for the privacy practices used by third-party sites and other online services. We suggest that you read the privacy policies of those sites and other online services carefully.

MINORS

We do not knowingly collect personal information directly from children under the age of 18 (“Minor(s)”). If we become aware of having received personal information from a Minor without verification of parental consent, we will delete it. Parents or guardians of Minors who may have provided their personal information, may request that such Minor’s personal information be deleted.

CALIFORNIA RESIDENTS

California residents have privacy rights Under the California Consumer Privacy Act of 2018 (CCPA). These rights apply to California residents and are in addition to the rights stated in this Privacy Policy.

We do not sell your Personal Information, and only use and disclose your Personal Information as stated in this Privacy Policy.

You have the right to request details about the information covered under the CCPA that we collect and disclose about you within the prior 12 months. You may also request that we delete your Personal Information. These rights are subject to the exceptions and limitations pursuant to the CCPA. You may email us at privacy@mcasuite.com to submit a deletion request with detail sufficient allows us to process your request. You may submit up to two requests in a 12-month period. By exercising your rights, you will not be subject to denial of services, increased fees, or otherwise treated differently.

YOUR DATA PROTECTION RIGHTS UNDER GENERAL DATA PROTECTION REGULATION (GDPR)

If you are a resident of the European Union and European Economic Area (EEA), you have certain data protection rights, covered by GDPR – see more at https://eur-lex.europa.eu/eli/reg/2016/679/oj.  We aim to take reasonable steps to allow you to correct, amend, delete, or limit the use of your Personal Information. If you wish to be informed what Personal Information we hold about you and if you want it to be removed from our systems, please email us at [provide email address]. In certain circumstances, you have the following data protection rights:

  • the right to access, update or to delete the information we have on you;
  • the right to have your information rectified if that information is inaccurate or incomplete;
  • the right to object to our processing of your Personal Information;
  • the right to request that we restrict the processing of your personal information;
  • the right to be provided with a copy of your Personal Information in a structured, machine-readable and commonly used format; and
  • the right to withdraw your consent at any time where we rely on your consent to process your Personal Information.

Please note that we may ask you to verify your identity before responding to such requests. Please note, we may not be able to provide the Services without some necessary data. You have the right to complain to a data protection authority about our collection and use of your Personal Information. MARKETING COMMUNICATIONS

You can opt out of receiving our marketing communications. Note that you will still receive non-marketing or transactional messages from us, including messages about your account and responses to your inquiries. To opt out of receiving our marketing communications, you can contact us as follows:

  • For promotional emails or text messages, follow the instructions included with the marketing communication.

MOBILE APPLICATION AND LOCATION-BASED SERVICES

  • You may control our collection and use of location-based information through our mobile applications by adjusting the settings on your mobile device. If you withdraw permission for mobile applications to access precise location data, we may continue to approximate your location based on information like your IP address.
  • You may completely opt out of all location-based information collection by us if you uninstall all of our mobile apps from your devices.

LIMITS ON USER DATA

Notwithstanding anything else in this Privacy Policy, if you provide MCA Suite access to your Google data (e.g., when you enable the email sync feature with your Google account, or otherwise enable MCA Suite to access your Google data), MCA Suite’s use of your data will be subject to these additional restrictions:

  • MCA Suite will only use access to read, write, modify or control Gmail message bodies (including attachments), metadata, headers, and settings to provide a web email client that allows users to compose, send, read, and process emails and will not transfer this Google data to others unless doing so is necessary to provide and improve these features, comply with applicable law, or as part of a merger, acquisition, or sale of assets.
  • MCA Suite will not use this Google data for serving advertisements.
  • MCA Suite will not allow humans to read this data unless we have your affirmative agreement for specific messages, doing so is necessary for security purposes such as investigating abuse, to comply with applicable law, or for MCA Suite’s internal operations and even then only when the data has been aggregated and anonymized.

MCA Suite’s use of information received and MCA Suite’s transfer of information to any other app from Google APIs will adhere to Google API Services User Data Policy, including the Limited Use requirements.

Additionally, we use information submitted through the MCA Suite or collected through e-mails using other platform technology providers to analyze the characteristics of our Clients and improve our Services. In such instances, MCA Suite may use and transfer data only using recommended methodologies and APIs approved by such other platform technology providers, including, e.g., Microsoft 365. Our applications’ use of APIs adheres to the respective user data policies of such platform technology providers, as applicable.
